Terms and Conditions of Service
These terms and conditions govern all commercial proposals, contracts, supply, and application services provided by IZOMATE (“the Company”) to clients, contractors, property owners, and developers (“the Client”) in the United Arab Emirates.
1. Quotations and Contract Validity
All written proposals and bill of quantities (BOQ) quotations issued by the Company are valid for thirty (30) days from the date of issue unless explicitly stated otherwise in writing. Acceptance of a quotation constitutes a legally binding service agreement incorporating these terms.
2. Site Preparation & Substrate Access
The Client is responsible for providing unhindered access to the work areas, reliable electricity and water supply at the work point, and ensuring that structural concrete substrates have achieved adequate cure (minimum 28 days for new cast concrete) before coating or membrane application commences.
3. Inspection, Testing & Handover
Upon completion of membrane application, the Company conducts a mandatory 48-hour hydrostatic flood test (where geometrically applicable). The Client or Client’s designated representative shall inspect the test alongside the Company’s engineer. Signature on the Handover Certificate confirms full acceptance of the works.
4. Warranty Terms & Scope
The Company issues written warranties ranging from twelve (12) to seventeen (17) years depending on the specified system. The warranty covers leaks arising directly from material defect or application failure. It excludes damage resulting from post-handover mechanical punctures, unauthorized structural modifications, structural settlement exceeding design tolerances, or force majeure events.
5. Governing Law
These terms and any contracts entered into shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the United Arab Emirates.
